Please read these Terms of Service carefully before using Opulence Operate. By using our platform, you agree to these terms.

1. Acceptance of Terms

  • By accessing or using Opulence Operate, you agree to be bound by these Terms of Service and our Privacy Policy.
  • If you are using the platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.
  • We reserve the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the revised terms.

2. Description of Service

  • Opulence Operate is an AI-powered real estate transaction coordination platform that provides automated workflow management, compliance checking, document coordination, deadline tracking, and multi-channel communications.
  • The platform uses artificial intelligence agents to assist with transaction tasks. AI recommendations are advisory and always subject to broker review and approval.
  • Opulence Operate is a coordination tool and does not provide legal, financial, or real estate advice. Users remain responsible for all transaction decisions and compliance with applicable laws.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials and for all activity under your account.
  • You must notify us immediately if you suspect unauthorized access to your account.
  • You must be at least 18 years old and legally authorized to conduct real estate transactions in your jurisdiction.

4. Subscription & Billing

  • Opulence Operate offers various subscription tiers as described on our Pricing page. Pricing is subject to change with 30 days' notice.
  • Subscriptions are billed monthly or annually through Stripe. You authorize us to charge your payment method on a recurring basis.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
  • Add-on services (e.g., platform DocuSign, custom AI agents) are billed separately as described at the time of purchase.

5. Acceptable Use

  • You agree to use the platform only for lawful real estate transaction coordination purposes.
  • You will not upload, transmit, or store any content that is illegal, fraudulent, defamatory, or infringes on the rights of others.
  • You will not attempt to reverse-engineer, decompile, or otherwise access the source code of the platform.
  • You will not use automated scripts, bots, or other tools to access the platform outside of our provided APIs.
  • You will not interfere with the security, integrity, or performance of the platform or its infrastructure.

6. Data & Content

  • You retain ownership of all data and content you upload to the platform.
  • You grant Opulence Operate a limited license to process your data as necessary to provide the services, including AI-powered analysis and coordination.
  • You are responsible for ensuring that you have the right to upload and share any data or documents through the platform.
  • We implement industry-standard security measures to protect your data, as described in our Privacy Policy.

7. Third-Party Integrations

  • The platform integrates with third-party services (DocuSign, Stripe, SendGrid, Twilio, Slack, Microsoft Teams, Gmail, and others).
  • Your use of third-party services is subject to their respective terms of service and privacy policies.
  • Opulence Operate is not responsible for the availability, accuracy, or performance of third-party services.
  • You may connect or disconnect third-party integrations at any time from your account settings.

8. AI Agents & Automation

  • AI agents operate under a human-in-the-loop model. Critical actions (e.g., sending documents for signature, external communications) require broker approval before execution.
  • While our AI agents are designed to be accurate and helpful, they may occasionally produce incorrect or incomplete results. You are responsible for reviewing and verifying all AI-generated output.
  • Opulence Operate is not liable for any losses or damages resulting from reliance on AI-generated recommendations without proper human review.

9. Limitation of Liability

  • Opulence Operate is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
  • Our total liability for any claim related to the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.
  • We are not responsible for any missed deadlines, compliance failures, or transaction issues that result from platform downtime, bugs, or user error.

10. Termination

  • We may suspend or terminate your account if you violate these terms or engage in activity that harms the platform or other users.
  • Upon termination, you may request an export of your data within 30 days. After 30 days, your data may be permanently deleted.
  • Provisions that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) will survive.

11. Dispute Resolution

  • These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
  • Any disputes arising from these terms or your use of the platform shall first be attempted to be resolved through good-faith negotiation.
  • If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).
